CARROLL COUNTY WIN!
Under Carroll County Code, Maryland employment law and the Fair Labor Standards Act (FLSA), employees must be compensated for the work and
duties for which they are qualified and perform, regardless of administrative tag. Unfortunately, that was not what was happening to Mr. Travis
Gouker, an employee of Carroll County Government and a proud member of MCEA Council #550.
Having passed the requisite Wastewater Collection System license exam and having completed the required experience on the job, Mr. Gouker was
excited to receive his pay increase after all his hard work. He eagerly applied for licensure and commenced the duties of a Mechanic II position after
receiving his license. However, he did not receive his pay increase upon submission of his application for licensure. Mr. Gouker reached out to his union and sought resolution. MCEA filed a grievance on his behalf to get what Mr. Gouker rightfully deserved and worked with him to ensure that he received backpay for the entire time while he performed
the duties as Mechanic II in the County. While the County argued that he shouldn’t receive the full amount of backpay, MCEA had the law and the facts on their side. We are happy to share that Mr, Gouker has been made whole and has received the full amount of backpay that he requested.
