On December 8, 2025, Lisa Bryant O'Day, an employee of the District Court of Maryland, was issued with a Three-Day leave forfeiture/suspension for alleged failure to perform the essential functions of her position. She turned to her Union MCEA for assistance.
MCEA filed an instant appeal arguing that the discipline be overturned, citing that the employees' actions did not constitute misconduct and are supported by long-standing office practices, operational necessity, and good faith judgement. MCEA also argued that the context of the discipline strongly suggests retaliation for previously filing a grievance, which is an unlawful and prohibited basis for discipline.
The hearing officer agreed and ordered that the discipline be rescinded and that the employee be made whole with all pay and benefits as provided by law.
