MCEA Wins for MTA Employee

MCEA WINS!

ACCOUNTABILITY. FAIRNESS. RESULTS.

MCEA successfully represented Ms. Crawford, an employee of the Maryland Transit Administration (MTA), in challenging a five-day unpaid suspension stemming from an alleged incident on July 7, 2026. Through effective representation and thorough cross-examination, MCEA secured a victory that resulted in the suspension’s rescission and the restoration of Ms. Crawford’s lost pay.

THE FACTS

  • July 7, 2026: The alleged incident occurred.
  • August 6, 2026: Ms. Crawford received a Notice of Discipline imposing a five-day unpaid suspension. The appointing authority later acknowledged that the notice was unsigned.
  • August 7, 2026: The appointing authority reissued the notice with the required signature.
  • September 24, 2026: At the disciplinary hearing, MCEA’s Labor Relations Specialist cross-examined the appointing authority, establishing that the original notice was unsigned and had to be reissued.

MCEA’S ARGUMENT

MCEA challenged the disciplinary action, arguing that:

  • The August 6 notice was not a fully executed disciplinary document.
  • The August 7 notice violated TSHR 7 N 4.5.
  • The disciplinary action violated the applicable 30-day time limit under COMAR Title 11, § 11.02.08.01.

MCEA maintained that the suspension should be overturned and Ms. Crawford compensated for all five days of lost pay.

THE RESULT: A COMPLETE VICTORY!

Management agreed with MCEA’s position and rescinded the suspension.

  • The five-day unpaid suspension was rescinded.
  • Ms. Crawford’s pay for all five days was restored.

Ms. Crawford expressed her thanks, saying:

“The MCEA was there from start to finish in my entire process. The importance of knowing policy and documented fact; proved to all involved that MCEA was on the ball from the start!”
